T\u00eb dy qytetet nuk ishin vet\u00ebm t\u00ebr\u00ebsi arkitektonike dhe kulturore, por edhe hap\u00ebsira t\u00eb organizuara politikisht dhe ekonomikisht, me monedh\u00ebn e tyre, flot\u00ebn dhe tregtin\u00eb e zhvilluar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ulqini ka qen\u00eb p\u00ebr shekuj me radh\u00eb qend\u00ebr e tregtis\u00eb, detaris\u00eb, kultur\u00ebs dhe jet\u00ebs urbane n\u00eb bregun lindor t\u00eb Adriatikut. Statusin e qytetit (municipiumit) e g\u00ebzonte q\u00eb nga viti 163 para er\u00ebs son\u00eb. Ve\u00e7an\u00ebrisht t\u00eb r\u00ebnd\u00ebsishme jan\u00eb d\u00ebshmit\u00eb p\u00ebr demokracin\u00eb, gjyq\u00ebsorin dhe organizimin e k\u00ebtij qyteti, t\u00eb cilat i sjell Agostino Pertusi n\u00eb punimin e tij <em>Per la storia di Dulcigno nei secoli XIV-XV e dei suoi statuti cittadini<\/em>, botuar n\u00eb vitin 1973 n\u00eb revist\u00ebn <em>Studi Veneziani<\/em> t\u00eb Institutit p\u00ebr historin\u00eb e shoq\u00ebris\u00eb dhe shtetit venedikas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kompozitori i njohur britanik, i lindur n\u00eb Napoli, Leopold de Wenzel, i kushtoi k\u00ebtij qyteti nj\u00eb polk\u00eb. T\u00eb gjith\u00eb shkrimtar\u00ebt dhe udh\u00ebp\u00ebrshkruesit e njohur \u2014 nga Johan Georg fon Hahn, Evlia \u00c7elebia, Edith Durham dhe Edward Lear deri te Isidora Sekuli\u0107 \u2014 i drejtohen Ulqinit si qytet. Vet\u00ebm Ministria jon\u00eb e Administrat\u00ebs Publike jo. N\u00eb fakt, n\u00eb propozimin e ligjit t\u00eb ri p\u00ebr vet\u00ebqeverisjen lokale, statusi i qytetit p\u00ebrcaktohet si nj\u00eb lloj i ve\u00e7ant\u00eb i nj\u00ebsis\u00eb s\u00eb vet\u00ebqeverisjes lokale q\u00eb p\u00ebrfaq\u00ebson nj\u00eb qend\u00ebr urbane, ekonomike, administrative, kulturore, turistike, arsimore ose sh\u00ebndet\u00ebsore dhe q\u00eb ka m\u00eb shum\u00eb se 10.000 banor\u00eb. Edhe pse Ulqini i p\u00ebrmbush t\u00eb gjitha k\u00ebto kritere, sipas propozimit t\u00eb ri t\u00eb ligjit, k\u00ebtij qyteti nuk i takon ky status p\u00ebr shkak t\u00eb kritereve dhe procedur\u00ebs p\u00ebr fitimin e statusit t\u00eb qytetit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cbsht\u00eb paradoksale q\u00eb sot, n\u00eb shekullin XXI, Propozim-ligji i ri p\u00ebr vet\u00ebqeverisjen lokale v\u00eb n\u00eb pik\u00ebpyetje pik\u00ebrisht identitetin historik, urban dhe qytet\u00ebrues t\u00eb Ulqinit. Sipas kritereve t\u00eb propozuara, qendra historike dhe urbane si Ulqini ose Kotori mund t\u00eb mbeten pa statusin e qytetit, nd\u00ebrsa komuna si Tivati ose Petnjica mund ta fitojn\u00eb at\u00eb status vet\u00ebm mbi baz\u00ebn e parametrave administrativ\u00eb dhe fiskal\u00eb. Me k\u00ebt\u00eb shp\u00ebrfillet plot\u00ebsisht dimensioni historik, kulturor dhe qytet\u00ebrues i qyteteve n\u00eb Mal te &nbsp;Zi. Dhe kjo nuk \u00ebsht\u00eb mang\u00ebsia e vetme e k\u00ebtij propozimligji. Fatkeq\u00ebsisht, ka edhe m\u00eb shum\u00eb. Le t\u2019i marrim me radh\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Edhe pse ligji formalisht fut parimin e \u201cdecentralizimit asimetrik\u201d, thelbi i tij tregon di\u00e7ka krejt tjet\u00ebr \u2014 forcimin e kontrollit t\u00eb shtetit mbi vet\u00ebqeverisjet lokale. N\u00eb vend t\u00eb transferimit real t\u00eb kompetencave dhe zbatimit t\u00eb parimit t\u00eb subsidiaritetit, ligji vendos mekanizma t\u00eb mbik\u00ebqyrjes s\u00eb shtuar, mund\u00ebsi nd\u00ebrhyrjeje t\u00eb Qeveris\u00eb dhe subordinim shtes\u00eb t\u00eb komunave ndaj organeve qendrore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ligji nuk jep p\u00ebrgjigje t\u00eb qart\u00eb p\u00ebr nj\u00eb nga pyetjet ky\u00e7e t\u00eb demokracis\u00eb lokale: a e menaxhon v\u00ebrtet nj\u00ebsia e vet\u00ebqeverisjes lokale t\u00ebr\u00eb territorin e komun\u00ebs s\u00eb saj? Kjo pyetje ka r\u00ebnd\u00ebsi vendimtare p\u00ebr Ulqinin dhe t\u00eb gjitha qytetet bregdetare, ve\u00e7an\u00ebrisht n\u00eb kontekstin e menaxhimit t\u00eb bregdetit, zonave turistike dhe hap\u00ebsirave strategjike.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ligji gjithashtu humb mund\u00ebsin\u00eb p\u00ebr t\u00eb p\u00ebrcaktuar nj\u00eb transformim t\u00eb v\u00ebrtet\u00eb digjital t\u00eb administrat\u00ebs. N\u00eb vend t\u00eb krijimit t\u00eb nj\u00eb portali unik p\u00ebrmes t\u00eb cilit qytetari do t\u00eb mund t\u00eb shihte t\u00eb gjitha marr\u00ebdh\u00ebniet e tij me shtetin dhe vet\u00ebqeverisjen lokale \u2014 taksat, urbanizmin, t\u00eb drejtat sociale, sh\u00ebrbimet komunale, lejet dhe sh\u00ebrbime t\u00eb tjera &#8211; fokusi i projektligjit \u00ebsht\u00eb vendosur mbi nj\u00eb sistem q\u00eb i sh\u00ebrben n\u00eb m\u00ebnyr\u00eb t\u00eb synuar shtetit p\u00ebr t\u00eb ndjekur, kontrolluar dhe n\u00ebnshtruar n\u00eb m\u00ebnyr\u00eb m\u00eb efikase vet\u00ebqeverisjet lokale p\u00ebrmes nj\u00eb sistemi t\u00eb centralizuar informativ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb problem i ve\u00e7ant\u00eb paraqet fakti q\u00eb kjo reform\u00eb nuk ka p\u00eblqim t\u00eb qart\u00eb dhe validim politik nga Bashkimi Evropian. Praktika evropiane e decentralizimit n\u00ebnkupton komunitete t\u00eb forta lokale, madje edhe autonomi fiskale me theks t\u00eb ve\u00e7ant\u00eb mbi parimin e subsidiaritetit, nd\u00ebrsa ky ligj ruan pozit\u00ebn dominuese t\u00eb pushtetit qendror.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ligji sjell edhe disa risi t\u00eb tjera, pa u shprehur qart\u00eb nevoja reale p\u00ebr to. K\u00ebshtu, nd\u00ebr t\u00eb tjera, parashihet mund\u00ebsia q\u00eb nj\u00eb komun\u00eb t\u00eb kryej\u00eb pun\u00eb nga kompetencat e saj n\u00eb territorin e nj\u00eb nj\u00ebsie tjet\u00ebr t\u00eb vet\u00ebqeverisjes lokale. Shtrohet pyetja \u2014 a ekziston v\u00ebrtet nevoja reale p\u00ebr nj\u00eb mekaniz\u00ebm t\u00eb till\u00eb dhe a e kan\u00eb k\u00ebrkuar komunat deri tani?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cbsht\u00eb e qart\u00eb, p\u00ebr shembull, se Komuna e Ulqinit mund t\u2019u sh\u00ebrbente n\u00eb m\u00ebnyr\u00eb m\u00eb efikase nevojave t\u00eb qytetar\u00ebve t\u00eb Bashk\u00ebsis\u00eb Lokale Ostros. A ekziston zgjidhje m\u00eb racionale p\u00ebr qytetar\u00ebt e Kraj\u00ebs, t\u00eb cil\u00ebve nd\u00ebrtesa e Komun\u00ebs s\u00eb Ulqinit u ndodhet 36 kilometra larg, ose rreth 43 minuta udh\u00ebtim, nd\u00ebrsa deri te nd\u00ebrtesa e Komun\u00ebs s\u00eb Tivarit duhet t\u00eb kalojn\u00eb 44 kilometra dhe t\u00eb udh\u00ebtojn\u00eb pothuajse 57 minuta, ku gjysma e asaj rruge ndodhet pik\u00ebrisht n\u00eb territorin e Komun\u00ebs s\u00eb Ulqinit?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">M\u00eb tej, ligji mund\u00ebson edhe bashkimin e komunave n\u00eb t\u00eb ashtuquajtur\u00ebn Asociacion, por me k\u00ebrkes\u00ebn specifike q\u00eb ato t\u00eb jen\u00eb t\u00eb pakt\u00ebn 13 (gjysma e numrit t\u00eb komunave n\u00eb Mal t\u00eb Zi). Pse pik\u00ebrisht ky num\u00ebr? A nuk na mjafton Bashk\u00ebsia e Komunave t\u00eb Malit t\u00eb Zi? Apo d\u00ebshirojm\u00eb t\u2019i grupojm\u00eb komunat sipas ndonj\u00eb \u00e7el\u00ebsi interesant? Komunat bregdetare, edhe pse kan\u00eb interesa t\u00eb p\u00ebrbashk\u00ebta zhvillimore, infrastrukturore dhe ekologjike, nuk mund t\u00eb bashkohen n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb sepse formalisht jan\u00eb vet\u00ebm 6. Sipas cilit \u00e7el\u00ebs tjet\u00ebr do t\u00eb grupoheshin komunat dhe a \u00ebsht\u00eb shprehur nevoja reale p\u00ebr di\u00e7ka t\u00eb till\u00eb?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebr shkak t\u00eb t\u00eb gjitha atyre q\u00eb u than\u00eb m\u00eb sip\u00ebr, \u00ebsht\u00eb e qart\u00eb se ky ligj paraqet nj\u00eb hap prapa kur b\u00ebhet fjal\u00eb p\u00ebr decentralizimin n\u00eb Mali i Zi. N\u00eb vend t\u00eb nj\u00eb reforme thelb\u00ebsore dhe gjith\u00ebp\u00ebrfshir\u00ebse t\u00eb sistemit t\u00eb vet\u00ebqeverisjes lokale, kemi fituar nj\u00eb kompromis normativ dhe nj\u00eb lloj \u201ckornize sistemore t\u00eb arnuar\u201d, t\u00eb p\u00ebrb\u00ebr\u00eb nga zgjidhje parciale q\u00eb nuk burojn\u00eb nga nevojat reale t\u00eb vet\u00ebqeverisjeve lokale, as nuk ofrojn\u00eb vizion t\u00eb qart\u00eb p\u00ebr zhvillimin e shtetit dhe marr\u00ebdh\u00ebniet nd\u00ebrmjet pushtetit qendror dhe atij lokal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb reform\u00eb kaq e r\u00ebnd\u00ebsishme nuk mund t\u00eb miratohet pjes\u00ebrisht. Ajo duhet t\u00eb zbatohet si nj\u00eb paket\u00eb e plot\u00eb ligjesh, s\u00eb bashku me reform\u00ebn e Ligjit p\u00ebr zgjedhjen e k\u00ebshilltar\u00ebve dhe deputet\u00ebve, pra \u00e7\u00ebshtjen e zgjedhjes direkte ose indirekte t\u00eb kryetar\u00ebve t\u00eb komunave, organizimin territorial t\u00eb Malit t\u00eb Zi dhe rip\u00ebrcaktimin e zhvillimit rajonal. Vet\u00ebm at\u00ebher\u00eb mund t\u00eb flitet seriozisht p\u00ebr modelin e vet\u00ebqeverisjes moderne evropiane. Modeli m\u00eb i suksessh\u00ebm \u00ebsht\u00eb ai ku komuniteti lokal ndien p\u00ebrfitime nga zhvillimi q\u00eb krijon. Kjo sigurisht nuk \u00ebsht\u00eb rasti tani, dhe ky ligj nuk e mund\u00ebson k\u00ebt\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mali i Zi pas hyrjes n\u00eb Bashkimi Evropian gjithsesi do t\u00eb duhet t\u2019i hap\u00eb s\u00ebrish k\u00ebto \u00e7\u00ebshtje. At\u00ebher\u00eb do t\u00eb duhet t\u00eb vendoset se si do t\u00eb zgjidhen kryetar\u00ebt e komunave dhe cilat kompetenca dhe t\u00eb ardhura do t\u2019u takojn\u00eb realisht komuniteteve lokale. N\u00eb at\u00eb proces do t\u00eb duhet t\u00eb hapet edhe \u00e7\u00ebshtja e t\u00ebr\u00ebsive natyrore, historike dhe ekonomike.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dhe n\u00eb fund, nj\u00eb v\u00ebshtrim i ve\u00e7ant\u00eb mbi rastin e Ulqinit, i cili nga nj\u00eb rajon me dy qytete q\u00eb fark\u00ebtonin monedh\u00ebn e tyre, n\u00ebse ky ligj miratohet, do t\u00eb hynte n\u00eb Bashkimin Evropian si nj\u00eb qytez\u00eb q\u00eb nuk menaxhon bregdetin e vet, zhvillimi i s\u00eb cil\u00ebs pengohet sistematikisht nga politika dhe ligje si ky. Si mund t\u00eb shpjegohet ndryshe fakti q\u00eb Ulqini \u00ebsht\u00eb i vetmi qytet n\u00eb bregdetin e Malit t\u00eb Zi q\u00eb nuk ka port, nd\u00ebrkoh\u00eb q\u00eb ka qen\u00eb qend\u00ebr e r\u00ebnd\u00ebsishme rajonale detare dhe tregtare q\u00eb para m\u00eb shum\u00eb se nj\u00eb shekulli, me monedh\u00ebn dhe flot\u00ebn e vet?!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prandaj, ky propozim ligj \u00ebsht\u00eb nj\u00eb p\u00ebrpjekje e pamjaftueshme dhe e pamenduar mir\u00eb p\u00ebr reform\u00ebn e sistemit, i cili k\u00ebrkon nj\u00eb konsensus shum\u00eb m\u00eb serioz shoq\u00ebror dhe politik dhe, si i till\u00eb, n\u00eb k\u00ebt\u00eb gar\u00eb me koh\u00ebn p\u00ebr miratimin e ligjeve t\u00eb r\u00ebnd\u00ebsishme p\u00ebr mbylljen e kapitujve negociues, nuk i p\u00ebrmbush kushtet p\u00ebr miratim t\u00eb p\u00ebrshpejtuar pa debat m\u00eb t\u00eb gjer\u00eb profesional dhe publik. Reforma e vet\u00ebqeverisjes lokale duhet t\u00eb jet\u00eb rezultat i nj\u00eb konsensusi serioz shoq\u00ebror, e jo i nj\u00eb eksperimenti normativ parcial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Integrimi evropian nuk guxon t\u00eb n\u00ebnkuptoj\u00eb dob\u00ebsim administrativ t\u00eb qyteteve historike si Ulqini, por pik\u00ebrisht t\u00eb kund\u00ebrt\u00ebn \u2014 forcimin e kapaciteteve t\u00eb tyre p\u00ebr t\u00eb menaxhuar zhvillimin e vet.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Shkruan: prof. dr.
