Prandaj, Kosova i plot\u00ebson t\u00eb gjitha kushtet dhe standardet p\u00ebr pranim n\u00eb K\u00ebshillin e Evrop\u00ebs, si dhe nj\u00eb q\u00ebndrim t\u00eb till\u00eb e kan\u00eb konfirmuar dhe ekspert\u00ebt juridik.<\/p>\n\n\n\n<p>Megjithat\u00eb, dy delegat\u00eb nga shumica parlamentare e Malit t\u00eb Zi: Maja Vukiqeviq, nga Partia Popullore Demokratike( konsiderohet si parti pro-serbe e pro-ruse) dhe Vasilije \u00c7arapiq, nga \u201cEuropa tani\u201d nuk u pajtuan me arsyetimin e spjegimin e Kryeraportueses, Dora Bokojani, dhe nuk votuan pro -pranimit t\u00eb Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs, edhe pse Mali i Zi e ka njohur Kosov\u00ebn si shtet t\u00eb pavarur, qysh n\u00eb vitin 2008. dhe ka vendosur marr\u00ebdh\u00ebnie diplomatike.<\/p>\n\n\n\n<p>Prandaj, fatkeq\u00ebsisht, delegat\u00ebt e lartpermendur devijuan nga politika e p\u00ebrcaktuar proevropiane e Malit t\u00eb Zi dhe nj\u00ebkosisht u solidarizuan me politik\u00ebn e \u201cBot\u00ebs serbe\u201dt\u00eb Serbis\u00eb, d.m.th. mbrojt\u00ebn politik\u00ebn e nj\u00eb shteti t\u00eb tjet\u00ebr dhe shkel\u00ebn \u201cMarr\u00ebveshjen\u201d e koalicionit q\u00eb ata e pat\u00ebn n\u00ebnshkruar se do t\u00eb jen\u00eb \u201clojal\u201d ndaj politik\u00ebs s\u00eb shtetit t\u00eb Malit t\u00eb Zi. Nd\u00ebrsa, delegati i tret\u00eb, Boris Mugosha, nga partia opozitare, Socialdemokrate, votoi pro-pranimit t\u00eb Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs.<\/p>\n\n\n\n<p>Po ashtu, nd\u00ebr t\u00eb tjer\u00eb dhe dy delegat\u00eb nga Bosnja dhe Hercegovina votuan kund\u00ebr pranimit t\u00eb Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs: Snezhana Novakoviq dhe Branisllav Barenoviq. Prandaj mund t\u00eb thuhet se dy t\u00eb tretat e delegat\u00ebve evropian me ide, vizione dhe q\u00ebndrime progresive votuan p\u00ebr pranimin e Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs, nd\u00ebrsa n\u00eb an\u00ebn tjet\u00ebr&nbsp; ata delegat\u00eb q\u00eb i p\u00ebrkasin ideologjis\u00eb dhe politik\u00ebs konservatore europiane, si dhe ata delegat\u00eb q\u00eb jan\u00eb ithtar\u00eb t\u00eb&nbsp; ideologjis\u00eb mitologjike ballkanike dhe politik\u00ebs t\u00eb bazuar n\u00eb religjion apo n\u00eb fundamentalizmin fetar, votuan kundra ose abstenuan. Mir\u00ebpo, nj\u00eb ideologji dhe politik\u00eb e till\u00eb nuk&nbsp; ka sjell as nuk i sjell asgj\u00eb t\u00eb mir\u00eb p\u00ebr t\u00eb drejtat dhe lirit\u00eb e njeriut. P\u00ebrkundrazi, ajo \u00ebsht\u00eb anakronike n\u00eb epok\u00ebn bashk\u00ebkohore t\u00eb kultur\u00ebs demokratike evropiane.<\/p>\n\n\n\n<p>Prandaj, mund\u00eb t\u00eb konstatohet se t\u00ebra partit\u00eb proserbe dhe proruse n\u00eb pushtetin aktual politik n\u00eb Mal t\u00eb Zi jan\u00eb kundra Kosovet si shtet t\u00eb pavarur. Perkundrazi ato Kosov\u00ebn e quaj\u00ebn \u201cpjes\u00eb\u201d t\u00eb Serbis\u00eb; shtet t\u00eb \u201crrejsh\u00ebm\u201d; territor p\u00ebrkoh\u00ebsisht t\u00eb \u201cpushtuar\u201d dhe k\u00ebrkojn\u00eb t\u00ebrheqjen e njohjes s\u00eb Kosov\u00ebs.<\/p>\n\n\n\n<p>An\u00ebtarsimi i Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs do t\u00eb ishte hapi m\u00eb i madh i Kosov\u00ebs deri me tani n\u00eb konsolidimin e subjektivitetit nd\u00ebrkomb\u00ebtar.&nbsp; P\u00ebrfitimet e Kosov\u00ebs me an\u00ebtar\u00ebsimin&nbsp; n\u00eb K\u00ebshillin e Evrop\u00ebs, priten t\u00eb jen\u00eb politike, sociale dhe juridike. P\u00ebr Kosov\u00ebn \u00ebsht\u00eb i r\u00ebnd\u00ebsish\u00ebm edhe p\u00ebr ar\u00ebsye, se ai organ shpesh quhet \u201cparahyrje\u201d n\u00eb Bashkimin Evropian. Andaj ai \u00ebsht\u00eb kusht i domosdosh\u00ebm p\u00ebr integrimin e Kosov\u00ebs n\u00eb BE. An\u00ebtarsimi i Kosov\u00ebs n\u00eb K\u00ebshillin e Evrop\u00ebs rrit mund\u00ebsin\u00eb q\u00eb Kosova t\u00eb mbroj\u00eb qytetar\u00ebt e saj t\u00eb cil\u00ebt kan\u00eb probleme t\u00eb natyrave t\u00eb ndryshme<\/p>\n\n\n\n<p>P\u00ebrmes an\u00ebtarsimit n\u00eb K\u00ebshillin e Evrop\u00ebs, Kosova si shtet dhe qytetar\u00ebt e saj, do t\u00eb kishin Gjykat\u00ebn Evropiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb Strazburg, si instanc\u00eb shtes\u00eb dhe efektive, p\u00ebr mbrojtjen e t\u00eb drejtave dhe lirive t\u00eb&nbsp; njeriut n\u00eb rast t\u00eb shkeljeve t\u00eb tyre nga shtetet an\u00ebtare, pra dhe t\u00eb Serbis\u00eb.<\/p>\n\n\n\n<p>Gjykata Evropian p\u00ebr t\u00eb drejtat e njeriut mund t\u2019i pranoj\u00eb ankesat nga \u00e7do individ, organizat joqeveritare ose grup personash t\u00eb cil\u00ebt pohojn\u00eb se jan\u00eb viktim\u00eb e cenimit t\u00eb t\u00eb drejtave t\u00eb njeriut t\u00eb p\u00ebrcaktuara me Konvent\u00eb Evropiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut ose n\u00eb protokolle pran\u00eb Kontvent\u00ebs, t\u00eb b\u00ebra nga ndonj\u00eb nj\u00eb prej pal\u00ebve t\u00eb larta kontraktuese, e q\u00eb kjo do t\u00eb thot\u00eb dhe nga vet\u00eb organet e shtetit t\u00eb Kosov\u00ebs, kur ata t\u2019i shterrin mjetet juridike nga organet p\u00ebrkat\u00ebse t\u00eb Kosov\u00ebs. Prandaj, \u00ebsht\u00eb me r\u00ebnd\u00ebsi t\u00eb n\u00ebnvizohet se k\u00ebtu individi b\u00ebhet pal\u00eb n\u00eb proces\/procedur\u00eb para nj\u00eb gjykate nd\u00ebrkomb\u00ebtar.<\/p>\n\n\n\n<p>Institucionet europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut kan\u00eb karakter subsidar apo ndihm\u00ebs n\u00eb raport me sistemin shtet\u00ebror p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut. N\u00eb qoft\u00eb se shteti nuk ka procedur\u00eb dhe ila\u00e7\u00eb juridik efektiv, ose n\u00ebse shteti nuk e siguron ila\u00e7in juridik adekuat dhe efektiv, ose n\u00ebse procedura e medikamentit juridik n\u00eb sistemin komb\u00ebtar nuk ka dh\u00ebn\u00eb rezultate t\u00eb k\u00ebnaqshme, at\u00ebher\u00eb ia fillon pun\u00ebn e vet gjykata &nbsp;europiane p\u00ebr t\u00eb drejtat e njeriut si dhe mekanizmat e tjer\u00eb.<\/p>\n\n\n\n<p>Prandaj, q\u00ebllimi i mekanizmave mbrojt\u00ebs europian\u00eb nuk \u00ebsht\u00eb n\u00eb aspektin e marrjeve t\u00eb vendimeve t\u00eb vend t\u00eb shtetit, ato vet\u00ebm m\u00ebnjanojn\u00eb l\u00ebshimet e b\u00ebra t\u00eb shteteve, n\u00ebse deri te ato mang\u00ebsi vihet n\u00eb fush\u00ebn e mbrojtjes t\u00eb t\u00eb drejtave t\u00eb njeriut, e cila \u00ebsht\u00eb pun\u00eb dhe detyr\u00eb kryesore e organeve shtet\u00ebrore.<\/p>\n\n\n\n<p>Mbrojtja e t\u00eb drejtave t\u00eb njeriut \u2013 sikurse e n\u00ebnvizon J. H. H. Weiler \u2013 \u00ebsht\u00eb b\u00ebr\u00eb imperativ i&nbsp; p\u00ebrbask\u00ebt juridik dhe politik. Ajo qasje e re e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut, \u00ebsht\u00eb b\u00ebr\u00eb sinjal i bindjes se standardi adekuat p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut n\u00eb rajonin europian nuk do t\u00eb&nbsp; mund t\u00eb realizohet n\u00eb m\u00ebnyr\u00eb konsekuente pa u vendosur mekanizmat mbikomb\u00ebtar\u00eb. &nbsp;Nd\u00ebrsa, respektimi, zbatimi dhe promovimi i t\u00eb drejtave t\u00eb njeriut dhe t\u00eb drejtave t\u00eb pakicave komb\u00ebtare jan\u00eb si kusht t\u00eb integrimeve europiane.<\/p>\n\n\n\n<p>Dometh\u00ebn\u00eb, qasja e re n\u00ebnkupton mund\u00ebsin\u00eb e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut nga institucionet mbikomb\u00ebtare. Nga ajo rrjedh \u2013 sikurse e thekson J. Frowein \u2013 se q\u00ebllimi i Konvent\u00ebs Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut \u00ebsht\u00eb pik\u00ebrisht integrimi i shteteve europiane.<\/p>\n\n\n\n<p>Mund t\u00eb konstatohet se n\u00eb kuad\u00ebr t\u00eb Sistemit Europian t\u00eb mbrojtjes t\u00eb t\u00eb drejtave t\u00eb njeriut, m\u00eb e r\u00ebnd\u00ebsishme \u00ebsht\u00eb Gjykata Europiane p\u00ebr t\u00eb drejtat e njeriut. Ajo Gjykat\u00eb, sikurse thot\u00eb M.P. Margulnaud, \u00ebsht\u00eb :\u201dRrota kryesore e nj\u00eb mekanizmi t\u00eb r\u00ebnd\u00ebsish\u00ebm t\u00eb zbatimit mbinacional Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut&#8230;\u201d Shikuar n\u00eb p\u00ebrgjith\u00ebsi, Gykata ka p\u00ebr detyr\u00eb p\u00ebr t\u00eb siguruar respektimin e detyrave p\u00ebr t\u00eb cilat n\u00eb pik\u00ebpamje t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut i kan\u00eb marr\u00eb p\u00ebrsip\u00ebr shtetet p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p>Vendimet e Gjykat\u00ebs jan\u00eb t\u00eb prera dhe kan\u00eb karakter detyrues. Shteti detyrohet q\u00eb t\u00eb marr\u00eb masa p\u00ebr k\u00ebnaqjen e viktimave, kurse aktgjykimi&nbsp; d\u00ebrgohet Komitetit t\u00eb Ministrave, i cili e b\u00ebn mbik\u00ebyrjen e zbatimit t\u00eb tij. Shteti \u00ebsht\u00eb i detyruar t\u00eb zbatoj\u00eb vendimin e Gjykat\u00ebs n\u00eb baz\u00eb t\u00eb nenit 46 t\u00eb Konvent\u00ebs Evropiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut. Refuzimi i vendimit t\u00eb Gjykat\u00ebs e shpie shtetin n\u00eb situat\u00eb konfrontimi me Komitetin e Ministrave, i cili \u00ebsht\u00eb i detyruar t\u00eb mbik\u00ebqyr\u00eb zbatimin e vendimit Gjyq\u00ebsor. Gjithashtu, me Statutin e K\u00ebshillit t\u00eb Evrop\u00ebs parashihet dhe mund\u00ebsia e pezullimit ose t\u00eb p\u00ebrjashtimit nga an\u00ebtarsia n\u00ebse nuk respekton parimet demokratike dhe t\u00eb drejtat e njeriut.<\/p>\n\n\n\n<p>S\u00eb fundi, si an\u00ebtar i delegacionit studimor i Avokatit t\u00eb Popullit t\u00eb Malizt t\u00eb Zi, kam qendruar n\u00eb Gjykat\u00ebn Evropiane p\u00ebr t\u00eb Drejtat e Njeriut n\u00eb Strazburg( nga 11 deri m\u00eb 14 n\u00ebntor 2014), ku nd\u00ebr t\u00eb tjera kam monitoruar pun\u00ebn e Dhom\u00ebs s\u00eb Madhe t\u00eb Gjykat\u00ebs Evropiane t\u00eb t\u00eb Drejtave t\u00eb Njeriut n\u00eb \u00e7\u00ebshtjen Gherghina kund\u00ebr shtetit t\u00eb Rumunis\u00eb mbi diskriminimin n\u00eb baz\u00eb t\u00eb aft\u00ebsis\u00eb s\u00eb kufizuar.
