Andaj duke e trajtuar k\u00ebt\u00eb \u00e7\u00ebshtje si t\u00eb domosdoshm\u00eb dit\u00eb m\u00eb par\u00eb Kuvendi i Malit t\u00eb Zi ka formuar grupin punues enkas p\u00ebr \u00a0reform\u00ebn zgjedhore \u00a0me 14 an\u00ebtar\u00eb (7 nga pozita e 7 nga opozita) me\u00a0 mandat nj\u00ebvje\u00e7ar. Ndon\u00ebse kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb ligj kompleks i cili trajton nj\u00eb gam\u00eb t\u00eb gjer\u00eb \u00e7\u00ebshtjesh, \u00a0afati kohor prej nj\u00eb viti i k\u00ebtij grupi punues si duket \u00a0i konvenon \u00a0m\u00eb shumti pushtetit aktual, sepse nuk do t\u00eb jen\u00eb n\u00eb rend t\u00eb dit\u00ebs zgjedhjet e parakohshme parlamentare, si\u00e7 jan\u00eb paralajm\u00ebruar muajve t\u00eb fundit.<\/p>\n<p><strong><em>\u00a0<\/em><\/strong><\/p>\n<p><strong>N\u00eb k\u00ebrkim t\u00eb drejtave t\u00eb mohuara <\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>N\u00eb vend q\u00eb t\u00eb drejtat e arritura t\u00eb mbrohen dhe t\u00eb avancohen, n\u00eb Mal t\u00eb Zi, ndodh\u00eb pik\u00ebrisht e kund\u00ebrta, ata mohohen sipas vullnetit politik t\u00eb pushtetit, ku ligji zgjedhor \u00ebsht\u00eb d\u00ebshmi transparente e nj\u00eb konstatimi t\u00eb till\u00eb.<\/p>\n<p>Pik\u00ebrisht nj\u00eb dukuri e till\u00eb ka ndodhur me mosrespektimin e Ligjit t\u00eb pakicave n\u00eb cilin theksohet s\u00eb t\u00eb drejtat e arritura nuk mund t\u00eb cenohen.Por, pik\u00ebrisht nj\u00eb ligj i till\u00eb nuk \u00ebsht\u00eb respektuar me rastin e miratimit t\u00eb ligjit zgjedhor n\u00eb vitin 2011, duke iu mohuar shqiptar\u00ebve \u201enj\u00ebsin\u00eb e tyre zgjedhore\u201c e cila jepte pes\u00eb deputet.<\/p>\n<p>Ishte nj\u00eb vendim kund\u00ebr shqiptar\u00ebve dhe t\u00eb arriturave t\u00eb tyre, ku i detyroj deputetet shqiptar\u00eb(4) t\u00eb l\u00ebshojn\u00eb seanc\u00ebn e parlamentit n\u00eb m\u00ebnyr\u00eb demonstrative, sepse ishte nj\u00eb votim kund\u00ebr barazis\u00eb qytetare e nacionale t\u00eb shqiptar\u00ebve. Por, shumic\u00ebs parlamentare as q\u00eb i interesonte nj\u00eb qendrim i till\u00eb i shqiptar\u00ebve dhe me shumic\u00eb votash(DPS-DF) miratoi ligjin e ri zgjedhor, i cili filloi t\u00eb zbatohet n\u00eb zgjedhjet vijuese parlamentare(2012).<\/p>\n<p>Ligji i ri zgjedhor shqiptar\u00ebve permes partive nacionale iu mund\u00ebson maksimalisht t\u00eb jen\u00eb t\u00eb p\u00ebrfaq\u00ebsuar me tre deputet. Pra, nga 4 deputet sa kishin nga zgjedhjet e vitit 2009, me k\u00ebt\u00eb ligj t\u00eb ri iu mund\u00ebsohet t\u00eb ken\u00eb maksimalisht 3 deputet. K\u00ebtu qendron edhe problemi sepse kat\u00ebr deputetet shqiptar\u00eb q\u00eb ishin m\u00eb par\u00eb, \u00a0si duket paraqitnin rrezik p\u00ebr pushtetin. Por, n\u00ebse\u00a0 analizohet\u00a0 ligji zgjedhor ekzistues, del qart\u00eb s\u00eb shqiptar\u00ebt permes subjekteve t\u00eb tyre nacionale, n\u00ebse b\u00ebjn\u00eb koalicione\u00a0 parimore, mund t\u00eb arrijn\u00eb t\u00eb fitojn\u00eb 2 deputet, nd\u00ebrsa i treti \u00a0mbetet si mund\u00ebsi teorike.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Infektimi me virusin e liderizmit<\/strong><\/p>\n<p>Pik\u00ebrisht, nga mos koordinimi i subjekteve politike shqiptare, n\u00eb saj\u00eb t\u00eb infektimit nga virusi i bajraktarizmit dhe liderizmit\u00a0 n\u00eb vend q\u00eb t\u00eb dalin n\u00eb zgjedhje me nj\u00eb apo dy lista zgjedhore ata dolen me 3-4 lista zgjedhore, duke djegur votat dhe mos arritur objektivin e d\u00ebshiruar. Dhe nj\u00eb konstatim i till\u00eb u d\u00ebshmu n\u00eb zgjedhjet vijuese n\u00eb vitin 2012, ku subjektet politike shqiptare \u00a0edhe pse \u00a0arriten t\u00eb fitojn\u00eb 12.500 vota \u00a0fituan vet\u00ebm \u00a02 deputet nd\u00ebrsa \u00a0n\u00eb vitin 2016, kemi nj\u00eb r\u00ebnie drastike n\u00eb 9.500 vota dhe u fitu vet\u00ebm \u00a01 deputet.<\/p>\n<p>Ishte ky nj\u00eb\u00a0 zhg\u00ebnjim i\u00a0 shqiptar\u00ebve, q\u00eb \u00ebsht\u00eb rezultat i ligjit zgjedhor \u00a0diskriminues \u00a0si dhe mos arritjes s\u00eb kompromisit n\u00eb mes vet subjekteve nacionale t\u00eb shqiptar\u00ebve, nga del se m\u00eb s\u00eb shumti p\u00ebrfitoj DPS-i, q\u00eb ishte projektuesi i nj\u00eb ligji t\u00eb till\u00eb zgjedhor. Por, n\u00ebse e krahasojm\u00eb numrin e votave p\u00ebr nj\u00eb deputet p\u00ebr subjektet tjera n\u00eb kuvendin e Malit t\u00eb Zi, del qart\u00eb se deputeti shqiptar ka kushtuar m\u00eb shum\u00eb se deputetet e subjekteve t\u00eb tjera, q\u00eb \u00ebsht\u00eb pasoj\u00eb e ligjit zgjedhor. Pik\u00ebrisht, k\u00ebtu qendron \u00a0mashtrimi politik me sintagmen e njohur \u201ediskriminimi pozitiv\u201c, q\u00eb me m\u00eb vend do t\u00eb ishte t\u00eb thuhej diskriminimi ligjor p\u00ebr shqiptar\u00ebt n\u00eb k\u00ebt\u00eb mjedis.<\/p>\n<p>Nuk ka dilem\u00eb se ky ishte \u00a0qellimi i pushtetit, q\u00eb shqiptar\u00ebt t\u00eb jen\u00eb t\u00eb p\u00ebrfaq\u00ebsuar\u00a0 sa p\u00ebr sy e faqe, \u00a0mund\u00ebsisht vet\u00ebm me nj\u00eb deputet, dhe \u00a0ai t\u00eb jet\u00eb n\u00ebn obrellen e pushtetit. Pra, e t\u00ebr\u00eb loja politike kishte qellimin q\u00eb t\u00eb zvoglohet pesha politike e shqiptar\u00ebve n\u00eb parlamentin e Malit t\u00eb Zi, sepse numri i tyre i lart\u00eb ka pasur mund\u00ebsi t\u00eb jet\u00eb edhe vendimtar \u00a0p\u00ebr miratimin e ligjeve t\u00eb ndryshme.<\/p>\n<p>Nd\u00ebrsa \u00ebsht\u00eb e tep\u00ebrt t\u00eb thuhet se po ishte numri i deputet\u00ebve shqiptar\u00eb autentik si n\u00eb vitin 2009, at\u00ebher ata do t\u00eb ishin vendimtar\u00eb p\u00ebr qeverin\u00eb aktuale, sepse t\u00eb gjith\u00eb jemi d\u00ebshmitar\u00eb se \u00e7far\u00eb p\u00ebrfitimit kan\u00eb arritur dy subjekte tjera(BS,SD) q\u00eb n\u00eb k\u00ebt\u00eb p\u00ebrb\u00ebrje (2016) jan\u00eb t\u00eb p\u00ebrfaq\u00ebsuar me vet\u00ebm nga dy deputet.<\/p>\n<p><strong><em>\u00a0<\/em><\/strong><\/p>\n<p><strong>Kroacia dhe Kosova\u00a0 model p\u00ebr Malin e Zi<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Pik\u00ebrisht, gjendja ekzistuese obligon p\u00ebr ndryshime cil\u00ebsore t\u00eb ligjit zgjedhor, madje jo duke shpikur di\u00e7ka t\u00eb re por duke marr\u00eb parasysh p\u00ebrvojen e vendeve tjera. N\u00eb k\u00ebt\u00eb aspekt si ma e pranueshme p\u00ebr Malin e Zi mund t\u00eb jet\u00eb modeli zgjedhor i pakicave n\u00eb Kroaci apo Kosov\u00eb.<\/p>\n<p>K\u00ebshtu Kroacia si an\u00ebtare e BE, iu ka kushtuar kujdes t\u00eb ve\u00e7ant\u00eb p\u00ebrfaq\u00ebsimit t\u00eb pakicave komb\u00ebtare, sepse p\u00ebr to ajo ka mandatet e garantuara. K\u00ebshtu ligji zgjedhor n\u00eb Kroaci p\u00ebr serb\u00ebt ka t\u00eb garantuar tre mandate, e pakicat tjera s\u00eb bashku pes\u00eb mandate. Madje k\u00ebsaj here shqiptar\u00ebt n\u00eb Kuvendin e Kroacis\u00eb jan\u00eb t\u00eb p\u00ebrfaq\u00ebsuar me nj\u00eb deputet, edhe pse ata marrin pjes\u00eb me 0.5% nga popullsia e p\u00ebrgjithshme. Nga ana tjet\u00ebr n\u00eb Kosov\u00eb, ligji zgjedhor avancon pakicat, ku n\u00eb rastin konkret p\u00ebr serb\u00ebt jan\u00eb 10 vende t\u00eb rezervuara, nd\u00ebrsa 10 mandate t\u00eb tjera jan\u00eb p\u00ebr pakicat tjera.<\/p>\n<p>N\u00ebse krahasojm\u00eb pjes\u00ebmarrjen e shqiptar\u00ebve n\u00eb popullsin\u00eb e p\u00ebrgjithshme n\u00eb Mal t\u00eb Zi, statistika zyrtare e paraqet 5%, dhe jan\u00eb t\u00eb p\u00ebrfaq\u00ebsuar me nj\u00eb deputet autentik, ngjajsh\u00ebm \u00ebsht\u00eb edhe n\u00eb Kroaci, ku shqiptar\u00ebt marrin pjes\u00eb me 0.5% e popullsis\u00eb s\u00eb p\u00ebrgjithshme dhe p\u00ebrfaq\u00ebsohen me nj\u00eb deputet. Dhe nga nj\u00eb e dh\u00ebn\u00eb e till\u00eb del se defekti \u00a0par\u00ebsor\u00a0 \u00ebsht\u00eb se kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb ligj zgjedhor i cili \u00ebsht\u00eb diskriminues p\u00ebr shqiptar\u00ebt n\u00eb Mal t\u00eb Zi, sepse nuk jan\u00eb marr\u00eb parasysh t\u00eb drejtat e arritura, por qendrimi mohues i pushtetit ndaj tyre, p\u00ebr qellime politike.<\/p>\n<p>Andaj, do t\u00eb ishte e udh\u00ebs \u00a0q\u00eb ata t\u00eb cil\u00ebt me votat e tyre kan\u00eb miratuar nj\u00eb ligj t\u00eb till\u00eb(DPS dhe DF), t\u00eb inicojn\u00eb rikthimin e t\u00eb drejtave t\u00eb mohuara, permes \u00a0ndryshimit t\u00eb ligjit zgjedhor. Dhe nj\u00eb mund\u00ebsi e till\u00eb tani ekziston, por, p\u00ebr nj\u00eb veprim t\u00eb till\u00eb\u00a0 konstruktiv \u00a0duhet vullnet politik, q\u00eb p\u00ebr momentin nuk shihet se ekziston, sepse n\u00eb rend t\u00eb par\u00eb \u00a0jan\u00eb interesat partiake e klaneve t\u00eb ndryshme e jo ato t\u00eb qytetar\u00ebve n\u00eb p\u00ebrgjith\u00ebsi e t\u00eb shqiptar\u00ebve n\u00eb ve\u00e7anti.<\/p>\n<p><strong><em>\u00a0<\/em><\/strong><\/p>\n<p><strong>P\u00ebr shqiptar\u00ebt\u00a0 nj\u00ebsi e ve\u00e7ant\u00eb zgjedhore apo mandate t\u00eb garnatuara<\/strong><\/p>\n<p>P\u00ebr t\u00eb pasur nj\u00eb ligj zgjedhor t\u00eb qendruesh\u00ebm, legjislativi \u00ebsht\u00eb i obliguesh\u00ebm t\u00eb miratoj\u00eb nj\u00eb ligj i cili do t\u00eb jet\u00eb i pranuesh\u00ebm edhe p\u00ebr pakicat komb\u00ebtare n\u00eb rastin konkret p\u00ebr shqiptar\u00ebt, t\u00eb cil\u00ebt jan\u00eb\u00a0 t\u00eb diskriminuar nga ligji zgjedhor ekzistues.Nj\u00eb vendim do t\u00eb eliminonte dilemat t\u00eb cilat ishin t\u00eb pranishme n\u00eb prag t\u00eb zgjedhjeve parlamentare, si\u00e7 ishte m\u00eb par\u00eb, apo me arritjen e 0.7% si kusht p\u00ebr t\u00eb hyr\u00eb n\u00eb gar\u00eb ne ndarjen e mandateve, p\u00ebrqindje kjo q\u00eb nuk garantonte n\u00eb realizimin e mandatit t\u00eb deputetit. Andaj, duke e par\u00eb si jo praktik ligjin zgjedhor ekzistues nga viti 2011, ku subjekti politik i shqiptar\u00ebve duhet t\u00eb fitoj\u00eb 0.7% p\u00ebr t\u00eb hyr\u00eb n\u00eb gar\u00eb p\u00ebr ndarje t\u00eb deputet\u00ebve e jo se e fiton ate, \u00a0\u00ebsht\u00eb e nevojshme ndryshimi i tij, q\u00eb mos t\u00eb ndodh si deri m\u00eb tash ku nj\u00eb mandat i deputetit autentik shqiptar\u00eb t\u00eb jet\u00eb dyfish me\u00a0 i votuar se deputetet\u00a0 tjer\u00eb \u00a0n\u00eb p\u00ebrb\u00ebrjen parlamentare n\u00eb Mal t\u00eb Zi.<\/p>\n<p>Pik\u00ebrisht, p\u00ebr t\u00eb eliminuar k\u00ebt\u00eb pabarazi praktike ligjore n\u00eb llogaritjen e mandatit t\u00eb deputet\u00ebve,\u00a0 \u00a0mendoj se ekzistojn\u00eb dy mund\u00ebsi q\u00eb jan\u00eb m\u00eb optimale e ata jan\u00eb: e para nj\u00ebsia e ve\u00e7ant\u00eb zgjedhore dhe e dyta ajo e \u00a0mandateve \u00a0t\u00eb garantuara.<\/p>\n<p>N\u00ebse n\u00eb lidhje me nj\u00ebsin\u00eb e ve\u00e7ant\u00eb zgjedhore ekziston nj\u00eb p\u00ebrvoj\u00eb e mjaftueshme sepse ka qen\u00eb e aplikuar n\u00eb praktik\u00eb, jo si nj\u00ebsi e dyt\u00eb zgjedhore por n\u00eb saj\u00eb t\u00eb vendvotimeve me popullsi shumic\u00eb shqiptare nga Ulqini n\u00eb jug e Rozhaja n\u00eb veri, ajo duhet t\u00eb modefikohet e plot\u00ebsohet me disa vendvotime t\u00eb reja shqiptare, q\u00eb n\u00eb t\u00eb kaluar\u00ebn pushteti i ka l\u00ebn\u00eb me qellim jasht\u00eb k\u00ebsaj \u201cnj\u00ebsie zgjedhore\u201d.<\/p>\n<p>N\u00eb saj\u00eb t\u00eb numrit t\u00eb votuesve kjo nj\u00ebsi do t\u00eb siguronte pes\u00eb mandate t\u00eb deputet\u00ebve ku p\u00ebrve\u00e7 subjekteve politike t\u00eb shqiptar\u00ebve do t\u00eb kishin mund\u00ebsi t\u00eb garonin edhe partit\u00eb tjera nga spektri i ashtuquajtur qytetar.P\u00ebrve\u00e7 votave nga kjo nj\u00ebsi subjekt\u00ebt konkuruese do t\u00eb kenin mund\u00ebsi t\u00eb marrin vota edhe nga vendvotimet tjera n\u00eb Mal t\u00eb Zi, si nj\u00ebsi zgjedhore, pra nuk ekziston kufizimi votave, por e kund\u00ebrta mund\u00ebsohet bartja nga vendvotimet e ndryshme.<\/p>\n<p>Nd\u00ebrsa modeli i mandat\u00ebve t\u00eb garantuara do t\u00eb ishte zgjidhje juridike, q\u00eb p\u00ebr t\u00eb par\u00ebn here do t\u00eb definohej n\u00eb Mal t\u00eb Zi, q\u00eb ka t\u00eb b\u00ebj\u00eb \u00a0n\u00eb p\u00ebrcaktimin e numrit t\u00eb deputet\u00ebve n\u00eb saj\u00eb t\u00eb elektoratit votues shqiptar\u00eb, q\u00eb varet nga kompromisi\u00a0 n\u00eb\u00a0 grupin punues dhe votimit nga shumica parlamentare.<\/p>\n<p>Po ashtu nuk duhet harruar faktin\u00a0 se n\u00eb ligjin zgjedhor \u00a0aktual ekziston sistemi i aksionit afirmativ p\u00ebr pakicat komb\u00ebtare, por me prag t\u00eb ndrysh\u00ebm p\u00ebr bashk\u00ebsi t\u00eb ndryshme komb\u00ebtare.\u00a0 N\u00eb k\u00ebt\u00eb aspekt del qart\u00eb se \u00a0kemi pabarazi praktike, q\u00eb duhet p\u00ebrpjekur t\u00eb eliminohet n\u00eb saj\u00eb t\u00eb mandateve t\u00eb garantuara, ku n\u00eb gar\u00eb \u00a0marrin pjes\u00eb vet\u00ebm subjektet e partive nacionale duke iu garantuar pjes\u00ebmarrjen n\u00eb parlament.<\/p>\n<p>Madje analist t\u00eb ndrysh\u00ebm jan\u00eb t\u00eb mendimit s\u00eb Kuvendi i Malit t\u00eb\u00a0 Zi i duhet t\u00eb miratoj\u00eb nj\u00eb ligj t\u00eb ri p\u00ebr zgjedhjen e k\u00ebshilltar\u00ebve e t\u00eb deputet\u00ebve, e jo ndryshimin e plot\u00ebsimin e tij, si\u00e7 pretendon t\u00eb realizoj\u00eb grupi punues\u00a0 i miratuar koh\u00eb me par\u00eb, n\u00eb parlamentin e Malit t\u00eb Zi.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Pun\u00ebt tona nuk i kryejn\u00eb t\u00eb tjer\u00ebt<\/strong><\/p>\n<p>P\u00ebrvoja e deritashme pluraliste me pushtetin n\u00eb Mal t\u00eb Zi, na b\u00ebn t\u00eb dyshojm\u00eb n\u00eb seriozitetin e tyre\u00a0 p\u00ebr ndryshime cil\u00ebsore\u00a0 n\u00eb ligjin zgjedhor, sepse ata do t\u00eb p\u00ebrpiqen si zakonisht p\u00ebr ndryshime\u00a0 kozmetike, duke ia p\u00ebrshtatur vet\u00ebs, e jo p\u00ebr\u00a0 shqiptar\u00ebt e popujt e tjer\u00eb pakic\u00eb n\u00eb k\u00ebt\u00eb mjedis.
