K\u00ebshilli n\u00eb fjal\u00eb \u00ebsht\u00eb formuar me 1949, kur disa shtete t\u00eb Europ\u00ebs Per\u00ebndimore t\u00eb frym\u00ebzuara me ide t\u00eb m\u00ebdha p\u00ebr bashkimin Europian, e kan\u00eb vendosur t\u00eb formojn\u00eb nj\u00eb organizat\u00eb rajonale me q\u00ebllim e arritjes m\u00eb t\u00eb madhe t\u00eb bashkimit t\u00eb shteteve europiane mbi baza t\u00eb demokracis\u00eb parlamentare, t\u00eb pushtetit ligjor dhe t\u00eb respektimit t\u00eb plot\u00eb t\u00eb t\u00eb drejtave dhe lirive t\u00eb njeriut.<\/p>\n<p>S\u00eb shpejti pas formimit, K\u00ebshilli i Europ\u00ebs e ka miratuar Konvent\u00ebn p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut dhe t\u00eb lirive themelore me 1950, n\u00eb Rom\u00eb, e cila ka hyr\u00eb n\u00eb fuqi me 1953.<\/p>\n<p>M\u00eb von\u00eb, pran\u00eb k\u00ebsaj Konvente jan\u00eb miratuar dhe 14 Protokolle, t\u00eb cilat paraqesin zgjerimin e p\u00ebrmbajtjes s\u00eb t\u00eb drejtave t\u00eb njeriut. Ajo \u00ebsht\u00eb kontrata e par\u00eb moderne, e cila merret me nj\u00eb s\u00ebri t\u00eb t\u00ebr\u00eb t\u00eb t\u00eb drejtave qytetare (civile) dhe politike dhe formon organet p\u00ebr mbrojtjen e tyre. Prandaj, eksperienca e tyre n\u00eb at\u00eb fush\u00eb \u00ebsht\u00eb dhe m\u00eb e pasura.<\/p>\n<p>Me Konventen Europiane jan\u00eb formuar dy organe: Komisioni europian p\u00ebr t\u00eb drejtat e njeriut (1954) dhe Gjyqi Europian p\u00ebr t\u00eb drejtat e njeriut (1959). P\u00ebrpos tyre, me Konvent\u00eb ky\u00e7en n\u00eb procedur\u00eb p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut edhe disa organe t\u00eb tjera t\u00eb cilat kan\u00eb qen\u00eb t\u00eb themeluara n\u00eb kuad\u00ebr t\u00eb K\u00ebshillit Europian: Komiteti i Ministrave dhe Sekretari i Pergjithsh\u00ebm i K\u00ebshillit Europian.<\/p>\n<p>Komisioni p\u00ebr t\u00eb drejtat e njeriut i ka pranuar k\u00ebrkesat nga shtetet an\u00ebtare, individ\u00ebt, grupet e personave ose organizatat joqeveritare, nd\u00ebrsa i ka shqyrtuar vet\u00ebm n\u00ebse shteti n\u00eb t\u00eb cilin ka pasur t\u00eb b\u00ebj\u00eb ka dh\u00ebn\u00eb deklarat\u00ebn se e pranon nj\u00eb kompetenc\u00eb t\u00eb till\u00eb. Komisioni i till\u00eb \u00ebsht\u00eb paraqitur si nd\u00ebrmjet\u00ebsues me q\u00ebllim t\u00eb arritjes s\u00eb marr\u00ebveshjes miq\u00ebsore dhe vet\u00ebm n\u00ebse deri te ajo nuk do t\u00eb vihet, rasti ka mundur t\u2019i dor\u00ebzohet gjyqit Europian. Mir\u00ebpo, kompetenca e gjyqit nuk ka qen\u00eb e detyruar. Nd\u00ebrkaq, n\u00eb fillimin e viteve n\u00ebnt\u00ebdhjet\u00eb me rritjen e numrit t\u00eb n\u00ebnshkrues\u00ebve t\u00eb Konvent\u00ebs Europiane \u00ebsht\u00eb shtuar dhe numri i l\u00ebnd\u00ebve q\u00eb kan\u00eb mbetur t\u00eb pazgjidhura, prandaj \u00ebsht\u00eb v\u00ebn\u00eb n\u00eb pyetje efikasiteti i k\u00ebtij sistemi. Mu p\u00ebr k\u00ebt\u00eb arsye reforma e tij \u00ebsht\u00eb b\u00ebr\u00eb e domodoshme.<\/p>\n<p>N\u00eb n\u00ebntor t\u00eb vitit 1998, ka hyr\u00eb n\u00eb fuqi Protokolli nr. 11 pran\u00eb Konvent\u00ebs Europiane.<\/p>\n<p>Me Protokollin e ri jan\u00eb parapar\u00eb nd\u00ebrrime me r\u00ebnd\u00ebsi. Para s\u00eb gjithash, formohet Gjyqi i ri europian p\u00ebr t\u00eb drejtat e njeriut, i cili tani do t\u00eb ekzistoj\u00eb si organ i p\u00ebrhersh\u00ebm dhe kompetencat e tij do t\u00eb jen\u00eb t\u00eb detyrueshme p\u00ebr t\u00eb gjitha shtetet kontraktuese (heqet e ashtuquajtura kompetenca fakultative e gjyqit). Pastaj, shfuqizohet Komisioni p\u00ebr t\u00eb drejtat e njeriut. Andaj, t\u00eb gjitha ankesat p\u00ebr cenimin e t\u00eb drejtave t\u00eb njeriut t\u00eb p\u00ebrcaktuara me Konvent\u00eb drejtp\u00ebrs\u00ebdrejti i d\u00ebrgohen Gjyqit Europian. Me nd\u00ebrrimet e k\u00ebtilla individi b\u00ebhet pal\u00eb n\u00eb proces\/procedur\u00eb para nj\u00eb gjyqi nd\u00ebrkomb\u00ebtar.<\/p>\n<p>Gjyqi Europian p\u00ebr t\u00eb drejtat e njeriut ka po aq gjykat\u00ebs sa ka edhe n\u00ebnshkrues t\u00eb Konvent\u00ebs Europiane, respektivisht numri i gjykat\u00ebseve t\u00eb k\u00ebtij gjyqi \u00ebsht\u00eb i nj\u00ebjt\u00eb me numrin e shteteve an\u00ebtare t\u00eb K\u00ebshillit Europian. Shteti propozon tre kandidat\u00eb p\u00ebr gjyq, prej t\u00eb cil\u00ebve Kuvendi Parlamentar i K\u00ebshillit Europian e zgjedh nj\u00eb (1) gjykat\u00ebs p\u00ebr nj\u00eb periudh\u00eb prej gjasht\u00eb (6)\u00a0 vjet\u00ebsh. Gjykat\u00ebsit mund t&#8217;i shkarkoj\u00eb vet\u00ebm gjyqi me dy t\u00eb tretat e shumic\u00ebs s\u00eb votave kur ta vler\u00ebsoj\u00eb se m\u00eb tej nuk i plot\u00ebsojn\u00eb kushtet e p\u00ebrcaktuara, p\u00ebrndryshe, gjykat\u00ebsit duhet t\u00eb g\u00ebzojn\u00eb nj\u00eb autoritet t\u00eb lart\u00eb moral dhe profesional. Ata duhet t&#8217;i ken\u00eb kualifikimet e nevojshme p\u00ebr kryerjen e funksioneve t\u00eb larta gjyq\u00ebsore n\u00eb shtetin e vet, respektivisht duhet t\u00eb jen\u00eb ekspert\u00eb juridik\u00eb t\u00eb d\u00ebshmuar e t\u00eb pranuar. Profesionalizmi, pavar\u00ebsia dhe objektiviteti duhet t\u00eb jen\u00eb cil\u00ebsit\u00eb kryesore t\u00eb \u00e7do gjykat\u00ebsi t\u00eb Gjyqi Europian. Ata veprojn\u00eb n\u00eb nj\u00eb cil\u00ebsi t\u00eb pavarur dhe nuk e mbrojn\u00eb shtetin i cili i ka kandiduar. Mund t\u00eb konstatohet se n\u00eb kuad\u00ebr t\u00eb Sistemit Europian t\u00eb mbrojtjes t\u00eb t\u00eb drejtave t\u00eb njeriut, m\u00eb i r\u00ebnd\u00ebsishmi \u00ebsht\u00eb Gjyqi Europian p\u00ebr t\u00eb drejtat e njeriut n\u00eb Strazbur. Ai Gjyq, sikurse thot\u00eb M. P. Margulnaud, \u00ebsht\u00eb: &#8220;Rrota kryesore e nj\u00eb mekanizmi t\u00eb r\u00ebnd\u00ebsish\u00ebm\u00a0 t\u00eb zbatimit mbinacional t\u00eb Konvent\u00ebs Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut\u2026&#8221;. Shikuar n\u00eb p\u00ebrgjith\u00ebsi, Gjyqi ka p\u00ebr detyr\u00eb p\u00ebr t\u00eb siguruar respektimin e detyrave p\u00ebr t\u00eb cilat n\u00eb pik\u00ebpamje t\u00eb mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut i kan\u00eb marr\u00eb p\u00ebrsip\u00ebr shtetet p\u00ebrkat\u00ebse.<\/p>\n<p>Kompetencate\u00a0 gjyqit jan\u00eb t\u00eb caktuara sipas parimeve vijuese: p\u00ebr t\u00eb shqyrtuar vet\u00ebm ato ankesa q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me t\u00eb drejtat e njeriut dhe lirit\u00eb themelore t\u00eb p\u00ebrmbajtura n\u00eb Konvent\u00ebn Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut ose n\u00eb protokolle pran\u00eb Konvent\u00ebs; Gjyqi mund t&#8217;i pranoj\u00eb ankesat nga \u00e7do individ, organizatat joqeveritare ose grup personash t\u00eb cil\u00ebt pohojn\u00eb se jan\u00eb viktim\u00eb e c\u00ebnimit t\u00eb t\u00eb drejtave t\u00eb p\u00ebrcaktuara me Konvent\u00eb dhe me protokolle t\u00eb saj, t\u00eb b\u00ebra nga ndonj\u00ebra prej pal\u00ebve t\u00eb larta kontraktuese.<\/p>\n<p>Gjithashtu, procedur\u00ebn para gjyqit europian p\u00ebr t\u00eb drejtat e njeriut mund ta nisin nj\u00eb ose m\u00eb shum\u00eb shtete p\u00ebr v\u00ebrtetimin e c\u00ebnimit t\u00eb t\u00eb drejtave t\u00eb njeriut t\u00eb p\u00ebrcaktuara me Konvent\u00eb Europiane. N\u00eb t\u00eb v\u00ebrtet\u00eb, ato jan\u00eb konfliktet apo mosmarrveshjet nd\u00ebrshtet\u00ebrore. Por ato nuk jan\u00eb aq t\u00eb r\u00ebnd\u00ebsishme, n\u00eb krahasim me rastet e ankesave individuale. Gjyqi nuk \u00ebsht\u00eb i autorizuar p\u00ebr t&#8217;i shqyrtuar rastet e c\u00ebnimit t\u00eb t\u00eb drejtave t\u00eb njeriut t\u00eb cilat kan\u00eb ndodhur para se Konventa ka hyr\u00eb n\u00eb fuqi ose para se shteti p\u00ebrkat\u00ebs e ka notifikuar Konvent\u00ebn Europiane p\u00ebr t\u00eb drejtat e njeriut. Po ashtu, sipas nenit 35 t\u00eb Konvent\u00ebs, Gjyqi nuk do ta shqyrtoj\u00eb k\u00ebrkes\u00ebn n\u00ebse i \u00ebsht\u00eb d\u00ebrguar dhe parashtruar gjyqit pas p\u00ebrfundimit kohor pas gjasht\u00eb muajsh prej dit\u00ebs kur \u00ebsht\u00eb marr\u00eb vendimi i prer\u00eb apo i plotfuqish\u00ebm.<\/p>\n<p>Kompetencat e Gjyqit jan\u00eb t\u00eb caktuara n\u00eb nenin 1 t\u00eb Konvent\u00ebs n\u00eb t\u00eb cilin shtetet &#8220;u garantojn\u00eb t\u00eb gjith\u00eb personave n\u00ebn juridiksionin e vet t\u00eb drejtat dhe lirit\u00eb n\u00eb pjes\u00ebn 1 t\u00eb k\u00ebsaj Konvente&#8221;. Mir\u00ebpo, juridiksioni i nj\u00eb shteti nuk \u00ebsht\u00eb identik me territorin komb\u00ebtar p\u00ebr t\u00eb gjith\u00eb ata \u00e7ka do t\u00eb mund t\u00eb b\u00ebj\u00eb jasht\u00eb territorit t\u00eb vet shtet\u00ebror.<\/p>\n<p>Gjyqi \u00ebsht\u00eb i autorizuar p\u00ebr ta v\u00ebrtetuar n\u00ebse ka ndonj\u00eb rast konkret t\u00eb c\u00ebnimit t\u00eb ndonj\u00eb t\u00eb drejte t\u00eb njeriut dhe t\u00eb vendos\u00eb m\u00ebnyr\u00ebn e kompensimit t\u00eb t\u00eb d\u00ebmtuarit. Gjyqi i mban mbledhjet n\u00eb k\u00ebshilla prej tre gjykat\u00ebsve, me seanca prej shtat\u00eb gjykat\u00ebsve. Procedura zhvillohet n\u00eb dy faza.<\/p>\n<p>Gjyqi s\u00eb pari e v\u00ebrteton, a i plotson ankesa t\u00eb gjitha kushtet p\u00ebr pranim. Sapo ankes\u00ebn ta shpallin t\u00eb pranueshme, gjyqi u v\u00ebhet n\u00eb dispozicion pal\u00ebve n\u00eb konflikt me q\u00ebllim t\u00eb arritjes s\u00eb marr\u00ebveshjes miq\u00ebsore. N\u00eb qoft\u00eb se nuk vihet deri te marr\u00ebveshja, seanca vazhdon shqyrtimin e l\u00ebnd\u00ebs dhe marrjen e vendimit. N\u00eb nj\u00eb afat prej tre (3) muajsh prej dit\u00ebs s\u00eb marrjes s\u00eb vendimit nga seanca gjyq\u00ebsore, secila prej pal\u00ebve mund t\u00eb k\u00ebrkoj\u00eb q\u00eb rasti t\u00eb procesohet para seanc\u00ebs s\u00eb Madhe Gjyq\u00ebsore. P\u00ebr k\u00ebt\u00eb vendos paneli nga pes\u00eb (5) gjykat\u00ebs, respektivisht Kolegiumi dhe ai do ta pranoj\u00eb k\u00ebrkes\u00ebn n\u00ebse e vler\u00ebson se me rastin procesohet nj\u00eb \u00e7\u00ebshtje\u00a0 me r\u00ebnd\u00ebsi q\u00eb ka t\u00eb b\u00ebj\u00eb me shpjegimin dhe zbatimin\u00a0 e Konvent\u00ebs Europiane dhe Protokolleve t\u00eb saj.<\/p>\n<p>N\u00eb qoft\u00eb se Kolegiumi e pranon\u00a0 k\u00ebrkes\u00ebn, seanca e madhe Gjyq\u00ebsore do ta marr\u00eb vendimin, i cili \u00ebsht\u00eb definitiv.<\/p>\n<p>Vendimet e Gjyqit jan\u00eb t\u00eb prera dhe kan\u00eb karakter detyrues. Shteti detyrohet q\u00eb t\u00eb marr\u00eb masa p\u00ebr k\u00ebnaqjen e viktimave, kurse aktgjykimi i d\u00ebrgohet Komitetit t\u00eb Ministrave, i cili e b\u00ebn mbikqyrjen e zbatimit t\u00eb tij. \u00c7\u00ebshtja e zbatimit t\u00eb v\u00ebrtet\u00eb t\u00eb vendimit t\u00eb Gjyqit \u00ebsht\u00eb padyshim &#8211; sikurse thekson Peter Leupretit &#8211; \u00e7\u00ebshtj\u00eb thelb\u00ebsore. Shteti \u00ebsht\u00eb i detyruar t\u00eb zbatoj\u00eb vendimin e Gjyqit n\u00eb baz\u00eb t\u00eb nenit 46 t\u00eb Konvent\u00ebs, i cili e p\u00ebrcakton se shtetet &#8220;e marrin p\u00ebrsip\u00ebr detyr\u00ebn e zbatimit t\u00eb vendimit t\u00eb gjyqit p\u00ebr \u00e7do l\u00ebnd\u00eb t\u00eb cilat jan\u00eb pal\u00eb&#8221;. Refuzimi i vendimi t\u00eb Gjyqit e shpie shtetin n\u00eb situat\u00eb konfrontimi me Komitetin e Ministrave, i cili \u00ebsht\u00eb\u00a0 i detyruar t\u00eb mbikqyr\u00eb zbatimin e vendimit Gjyq\u00ebsor. Gjithashtu, me Statutin e K\u00ebshillit Europian parashihet dhe mund\u00ebsia e pezullimit ose t\u00eb p\u00ebrjashtimit nga an\u00ebtar\u00ebsia n\u00ebse nuk respekton parimet demokratike dhe t\u00eb drejtat e njeriut.<\/p>\n<p>Nga ajo q\u00eb u tha m\u00eb lart, rrjedh se pas shum\u00eb shekujve t\u00eb sovranitetit absolut n\u00eb fush\u00ebn e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut, shtetet e Europ\u00ebs tani jan\u00eb gjetur n\u00eb nj\u00eb situat\u00eb q\u00eb &#8220;mbi vehten&#8221; kan\u00eb mekanizma t\u00eb ve\u00e7ant\u00eb nd\u00ebrkomb\u00ebtar\u00eb gjyq\u00ebsore dhe t\u00eb tjera p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut. Ajo ka t\u00eb b\u00ebj\u00eb me format e garancis\u00eb kolektive, me t\u00eb cilat sigurohet se shtetet do t&#8217;i send\u00ebrtojn\u00eb detyrat e veta, t\u00eb cilat i kan\u00eb pranuar me n\u00ebnshkrimin e nj\u00eb Konvente e cila sipas vokacionit t\u00eb saj themelor, e ka q\u00ebllimin p\u00ebr t\u00eb mbrojtur t\u00eb drejtat e njeriut.<\/p>\n<p>Institucionet europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut kan\u00eb karakter subsidiar apo ndihm\u00ebs n\u00eb raport me sistemin shtet\u00ebror p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut. N\u00eb qoft\u00eb se shteti nuk ka procedur\u00eb dhe ila\u00e7 juridik efektiv, ose n\u00ebse shteti nuk e siguron ila\u00e7in juridik adekuat dhe efektiv, ose n\u00ebse procedura e medikamentit juridik n\u00eb sistemin komb\u00ebtar nuk ka dh\u00ebn\u00eb rezultate t\u00eb k\u00ebnaqshme, at\u00ebher\u00eb ia fillon pun\u00ebn e vet gjyqi europian p\u00ebr t\u00eb drejtat e njeriut si dhe mekanizmat e tjer\u00eb.<\/p>\n<p>Prandaj, q\u00ebllimi i mekanizmave mbrojt\u00ebs europian\u00eb nuk \u00ebsht\u00eb n\u00eb aspektin e marrjeve t\u00eb vendimeve t\u00eb vend t\u00eb shtetit, ato vet\u00ebm m\u00ebnjanojn\u00eb l\u00ebshimet e b\u00ebra t\u00eb shteteve, n\u00ebse deri te ato mang\u00ebsi vihet n\u00eb fush\u00ebn e mbrojtjes t\u00eb t\u00eb drejtave t\u00eb njeriut, e cila \u00ebsht\u00eb pun\u00eb dhe detyr\u00eb kryesore e organeve shtet\u00ebrore.<\/p>\n<p>Mbrojtja e t\u00eb drejtave t\u00eb njeriut &#8211; sikurse e n\u00ebnvizon J. H. H. Weiler &#8211; \u00ebsht\u00eb b\u00ebr\u00eb imperativ i p\u00ebrbashk\u00ebt juridik dhe politik. Ajo qasje e re e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut, \u00ebsht\u00eb b\u00ebr\u00eb sinjal i bindjes se standardi adekuat p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut n\u00eb rajonin europian nuk do t\u00eb mund t\u00eb realizohet n\u00eb m\u00ebnyr\u00eb konsekuente pa u vendosur mekanizmat mbikomb\u00ebtar\u00eb. Nd\u00ebrsa, respektimi, zbatimi dhe promovimi i t\u00eb drejtave t\u00eb njeriut dhe t\u00eb detyrave t\u00eb pakicave komb\u00ebtare jan\u00eb si kusht t\u00eb integrimeve europiane.<\/p>\n<p>Dometh\u00ebn\u00eb, qasja e re n\u00ebnkupton mund\u00ebsin\u00eb e mbrojtjes s\u00eb t\u00eb drejtave t\u00eb njeriut nga institucionet mbikomb\u00ebtare. Nga ajo rrjedh &#8211; sikurse e thekson J. Frowein &#8211; se q\u00ebllimi i Konvent\u00ebs Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut \u00ebsht\u00eb pik\u00ebrisht integrimi i shteteve europiane.<\/p>\n<p>Pas shpalljes s\u00eb pavar\u00ebsis\u00eb, Mali i Zi s\u00eb shpejti \u00ebsht\u00eb pranuar n\u00eb K\u00ebshillin Europian dhe e ka n\u00ebnshkruar Konvent\u00ebn Europiane p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb njeriut. Prandaj, vendi yn\u00eb hyn n\u00eb nj\u00eb pozicion\u00a0 t\u00eb ri historik, social dhe politik, sepse t\u00eb gjitha \u00e7\u00ebshtjet m\u00eb t\u00eb r\u00ebndsishm\u00eb t\u00eb zbatimit t\u00eb Konvent\u00ebs Europiane menj\u00ebher\u00eb jan\u00eb b\u00ebr\u00eb aktuale.
