Mir\u00ebpo, shoq\u00ebrit\u00eb bashk\u00ebkohore njohin dukurin\u00eb e institucionalizimit, p\u00ebrkat\u00ebsisht t\u00eb form\u00ebsimit juridik t\u00eb masave t\u00eb detyrueshme me an\u00eb t\u00eb t\u00eb cilave leht\u00ebsohet dhe sigurohet egaliteti dhe barazia e pakicave n\u00eb sferat e ndryshme t\u00eb jet\u00ebs shoq\u00ebrore. Masat e k\u00ebtilla n\u00eb kuptimin m\u00eb t\u00eb gjer\u00eb em\u00ebrtohen si aksion afirmativ, por jan\u00eb n\u00eb p\u00ebrdorim edhe nocione t\u00eb tjera: diskriminimi pozitiv,\u00a0 diskriminimi i pad\u00ebmsh\u00ebm, trajtimi preferencial, sistemi i kuotave etj.<\/p>\n<p>Aksioni afirmativ nga nj\u00ebra an\u00eb shikohet si kompensim apo shp\u00ebrblim p\u00ebr diskriminimin n\u00eb t\u00eb kaluar\u00ebn, kurse nga ana tjet\u00ebr ai u kund\u00ebrvihet paragjykimeve t\u00eb sotme dhe nj\u00ebanshm\u00ebris\u00eb s\u00eb dh\u00ebn\u00ebsve t\u00eb vendimeve, si dhe padrejt\u00ebsis\u00eb dhe diskriminimit t\u00eb pakicave. Ndon\u00ebse politika diskriminuese sot \u00ebsht\u00eb e kund\u00ebrligjshme dhe e ndaluar, pakicat e ve\u00e7anta jan\u00eb edhe tutje viktima t\u00eb stereotipeve dhe t\u00eb nj\u00ebanshm\u00ebris\u00eb s\u00eb atyre q\u00eb marrin vendime, t\u00eb cil\u00ebt i p\u00ebrkasin shumic\u00ebs, p\u00ebrkat\u00ebsisht nga grupimet e favorizuara. Kurse m\u00eb e keqja ndodh at\u00ebher\u00eb dhe kur disa nga t\u00eb ashtuquajturit funksionar\u00eb publik\u00eb nga pakica e ve\u00e7ant\u00eb diskriminojn\u00eb pjes\u00ebtar\u00ebt e pakic\u00ebs tjet\u00ebr etnonacionale.<\/p>\n<p>S\u00eb k\u00ebndejmi, n\u00eb institucionet e sistemit politik duhet t\u00eb ekzistojn\u00eb programe t\u00eb fuqishme t\u00eb politik\u00ebs s\u00eb aksionit afirmativ, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb ken\u00eb efekt t\u00eb caktuar n\u00eb ndryshimin e struktur\u00ebs themelore t\u00eb grupimeve t\u00eb favorizuara dhe t\u00eb diskriminuara. Kjo \u00ebsht\u00eb k\u00ebrkes\u00eb p\u00ebr drejt\u00ebsi sociale, p\u00ebrkat\u00ebsisht p\u00ebr ndreqjen e padrejt\u00ebsis\u00eb shoq\u00ebrore p\u00ebr liri, vet\u00ebp\u00ebrcaktim dhe dinjitet. N\u00eb p\u00ebrputhje me k\u00ebt\u00eb, ithtar\u00ebt e multikulturalizmit jan\u00eb t\u00eb orientuar kund\u00ebr ideologjive shtyp\u00ebse dhe praktikave shoq\u00ebrore q\u00eb i referohen objektivitetit t\u00eb rrejsh\u00ebm, universalitetit dhe shtetit qytetar, kurse n\u00eb realitet u sh\u00ebrbejn\u00eb interesave t\u00eb ve\u00e7anta t\u00eb grupeve dominuese t\u00eb shoq\u00ebris\u00eb. Politika e multikulturalizmit njeh legjitimitetin e ve\u00e7antis\u00eb kulturore dhe sociale t\u00eb pakicave komb\u00ebtare. Modeli i multikulturalizmit n\u00ebnkupton se individ\u00ebt dhe grupet e ndryshme kulturore mund t\u00eb inkorporohen plot\u00ebsisht n\u00eb shoq\u00ebri, duke mos humbur ve\u00e7antin\u00eb e vet apo mund\u00ebsin\u00eb p\u00ebr participim t\u00eb plot\u00eb n\u00eb shoq\u00ebrin\u00eb e gjer\u00eb. Pik\u00ebrisht ky proces \u00ebsht\u00eb proces i participimit t\u00eb plot\u00eb i kuptuar si ky\u00e7 p\u00ebr tejkalimin e kund\u00ebrth\u00ebnieve etnike, tendosjeve etnike dhe demokracis\u00eb jostabile. P\u00ebr ta arritur k\u00ebt\u00eb q\u00ebllim t\u00eb participimit t\u00eb plot\u00eb, institucionet shtet\u00ebrore duhet t\u00eb transformohen thell\u00ebsisht n\u00eb m\u00ebnyr\u00eb q\u00eb t\u2019u sigurojn\u00eb pakicave komb\u00ebtare mund\u00ebsi t\u00eb barabarta t\u00eb shfryt\u00ebzimit t\u00eb sip\u00ebrfaqeve publike.<\/p>\n<p>Multikulturalizmi \u00ebsht\u00eb padyshim opozit\u00eb ndaj paragjykimeve etnike dhe bazohet mbi afilacione relativisht t\u00eb q\u00ebndrueshme.<\/p>\n<p>N\u00eb dallim nga neutraliteti i zakonsh\u00ebm\u00a0 i trajtimit jodiskriminues ndaj pakicave, aksioni afirmativ shquhet me nd\u00ebrmarrjen e masave pozitive q\u00eb kan\u00eb p\u00ebr q\u00ebllim t\u00eb avancojn\u00eb pozit\u00ebn e pakicave n\u00eb shoq\u00ebri dhe n\u00eb sistemin politik t\u00eb vendit konkret. Bie fjala, p\u00ebrfaq\u00ebsimi i pakicave n\u00eb organet e pushtetit &#8211; n\u00eb forumin legjislativ, n\u00eb organet ekzekutive dhe administrative, n\u00eb jurisprudenc\u00eb dhe n\u00eb sh\u00ebrbimet publike, n\u00eb institucionin e Avokatit t\u00eb Popullit si dhe n\u00eb institucionet arsimore, kulturore dhe informative etj.<\/p>\n<p>Pra, aksioni afirmativ mund t\u00eb p\u00ebrfshij\u00eb nj\u00eb gam\u00eb t\u00eb gjer\u00eb t\u00eb masave t\u00eb ndryshme n\u00eb favor t\u00eb t\u00eb drejtave t\u00eb pakicave. Masat e aksionit afirmativ kan\u00eb p\u00ebr q\u00ebllim vendosjen e barazis\u00eb reale, n\u00eb dallim nga ajo formale, vet\u00ebm t\u00eb proklamuar, t\u00eb pakic\u00ebs me shumic\u00ebn. Realizimi i barazis\u00eb midis individ\u00ebve dhe grupeve, pavar\u00ebsisht nga dallimet p\u00ebrkitazi me prejardhjen, rac\u00ebn, besimin, gjuh\u00ebn apo gjinin\u00eb, \u00ebsht\u00eb q\u00ebllim thelb\u00ebsor i mbrojtjes s\u00eb pakicave.<\/p>\n<p>N\u00eb koh\u00ebn e sotme, nje s\u00ebr\u00eb aktesh me karakter juridik nd\u00ebrkomb\u00ebtar p\u00ebrmban norma p\u00ebr masat e aksionit afirmativ, i cili n\u00eb realitet i autorizon shtetet p\u00ebr nd\u00ebrmarrjen e masave t\u00eb tilla. \u00cbsht\u00eb fjala p\u00ebr disa nga konventat m\u00eb t\u00eb r\u00ebnd\u00ebsishme n\u00eb sfer\u00ebn e t\u00eb drejtave t\u00eb njeriut dhe t\u00eb mbrojtjes s\u00eb tyre, si\u00e7 jan\u00eb:<\/p>\n<p>Konventa nd\u00ebrkombetare p\u00ebr zhdukjen e t\u00eb gjitha formave t\u00eb diskriminimit racial, Konventa kuad\u00ebr p\u00ebr mbrojtjen e pakicave nacionale dhe Konventa e Organizat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Pun\u00ebs, nr. 107 mbi popujt autokton\u00eb dhe fisnor\u00eb (1958) dhe nr. 111 kund\u00ebr diskriminimit n\u00eb lidhje me pun\u00ebsimin dhe profesionin (1958) etj.<\/p>\n<p>Konventat e lartp\u00ebrmendura t\u00eb cilat p\u00ebrmbajn\u00eb norma mbi masat e aksionit afirmativ obligojne edhe Malin e Zi p\u00ebr t\u2019i implementuar ato. K\u00ebsisoji, Konventa kuad\u00ebr p\u00ebr mbrojtjen e pakicave nacionale, n\u00eb nenin 4, paragrafi 2 p\u00ebrmban norm\u00ebn e cila obligon shtetin ton\u00eb q\u00eb n\u00eb fushat e jet\u00ebs ekonomike, sociale, politike dhe kulturore, aty ku \u00ebsht\u00eb e nevojshme, t\u00eb miratoj\u00eb masat p\u00ebrkat\u00ebse p\u00ebr avancimin e barazis\u00eb s\u00eb plot\u00eb dhe efektive t\u00eb pakicave nacionale.<\/p>\n<p>\u00cbsht\u00eb me r\u00ebnd\u00ebsi t\u00eb ceken edhe Rekomandimet nd\u00ebrkomb\u00ebtare nga Lundi mbi pjes\u00ebmarrjen efektive t\u00eb pakicave nacionale n\u00eb jet\u00ebn publike (1999), q\u00eb jan\u00eb shprehje e nevoj\u00ebs q\u00eb problemi i pjes\u00ebmarrjes s\u00eb pakic\u00ebs nacionale n\u00eb jet\u00ebn publike t\u00eb shprehet n\u00eb form\u00ebn e rekomandimeve p\u00ebr shtetet. Zbatimi n\u00eb jet\u00eb i k\u00ebsaj t\u00eb drejte vler\u00ebsohet si pjes\u00eb thelb\u00ebsore e shoq\u00ebris\u00eb paqedash\u00ebse dhe demokratike. Ekzistojn\u00eb dy forma thelb\u00ebsore t\u00eb k\u00ebsaj t\u00eb drejte: pjes\u00ebmarrja n\u00eb marrjen e vendimeve dhe vet\u00ebqeverisja.<\/p>\n<p>Sa i p\u00ebrket pjes\u00ebmarrjes n\u00eb marrjen e vendimeve shteteve u rekomandohet q\u00eb t\u00eb sigurojn\u00eb p\u00ebrfaq\u00ebsimin e posa\u00e7\u00ebm t\u00eb pakicave n\u00eb t\u00eb gjitha institucionet e sistemit politik dhe juridik dhe q\u00eb normat juridike t\u00eb sh\u00ebrbimeve publike t\u00eb jen\u00eb edhe n\u00eb gjuh\u00ebt e pakicave. Gjithashtu, shteteve u duhet q\u00eb n\u00eb procesin e zgjedhjeve t\u00eb sigurojn\u00eb pjes\u00ebmarrjen e pakicave (t\u00eb votojn\u00eb, t\u00eb jen\u00eb t\u00eb kandiduar) si dhe t\u2019u mund\u00ebsojn\u00eb themelimin e partive politike. Rekomandohet q\u00eb sistemi elektoral t\u00eb jet\u00eb i till\u00eb q\u00eb pakicave t\u2019ua leht\u00ebsoj\u00eb p\u00ebrfaq\u00ebsimin dhe influenc\u00ebn (p\u00ebr shembull q\u00eb t\u00eb jepen disa forma t\u00eb votimit preferencial). Rekomandohet edhe formimi i forumeve konsultative si kanale p\u00ebr dialog midis organeve qeveritare dhe pakicave nacionale.<\/p>\n<p>Form\u00eb tjet\u00ebr e pjes\u00ebmarrjes s\u00eb pakicave komb\u00ebtare n\u00eb jet\u00ebn publike paraqet dh\u00ebnia e vet\u00ebqeverisjes. Qoft\u00eb kur kemi t\u00eb b\u00ebjm\u00eb me zgjidhjet territoriale apo jasht\u00eb territoriale, dh\u00ebnia e vet\u00ebqeverisjes rekomandohet kur nj\u00eb gj\u00eb t\u00eb till\u00eb e k\u00ebrkon pjes\u00ebmarrja fryt\u00ebdh\u00ebn\u00ebse e pakicave n\u00eb jet\u00ebn publike.<\/p>\n<p>Autonomit\u00eb jan\u00eb form\u00eb e posa\u00e7me institucionale e sigurimit t\u00eb participimit politik t\u00eb pakicave komb\u00ebtare. Ato m\u00eb s\u00eb shpeshti jan\u00eb territoriale, ashtu q\u00eb nj\u00eb territor i caktuar n\u00eb t\u00eb cilin jetojn\u00eb pjes\u00ebtar\u00ebt e pakic\u00ebs komb\u00ebtare fiton status t\u00eb ve\u00e7ant\u00eb. N\u00eb nj\u00eb pozicion t\u00eb till\u00eb ato fitojn\u00eb t\u00eb drejt\u00ebn p\u00ebr t\u00eb rregulluar n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur \u00e7\u00ebshtje dhe raporte t\u00eb shumta, sidomos ato q\u00eb jan\u00eb me r\u00ebnd\u00ebsi jetike p\u00ebr banor\u00ebt e saj (t\u00eb cil\u00ebt n\u00eb numrin m\u00eb t\u00eb madh dhe kryesisht jan\u00eb nga p\u00ebrb\u00ebrja e pakicave komb\u00ebtare). Form\u00eb e ve\u00e7ant\u00eb e autonomive jan\u00eb t\u00eb ashtuquajturat vet\u00ebqeverisje t\u00eb pakicave, t\u00eb cilat g\u00ebzojn\u00eb t\u00eb drejt\u00ebn e p\u00ebrfaq\u00ebsimit t\u00eb interesave t\u00eb pjes\u00ebtar\u00ebve t\u00eb pakic\u00ebs s\u00eb vet komb\u00ebtare, madje t\u00eb kryejn\u00eb p\u00ebr ta edhe pun\u00eb t\u00eb caktuara publike, p\u00ebrfshir\u00eb edhe ato q\u00eb jan\u00eb n\u00eb fush\u00ebveprimin e organeve t\u00eb pushtetit ekzekutiv. P\u00ebrve\u00e7 k\u00ebsaj, jan\u00eb gjithnj\u00eb e m\u00eb t\u00eb shpeshta k\u00ebrkesat q\u00eb, krahas autonomive territoriale ekzistojn\u00eb edhe t\u00eb ashtuquajturat autonomi funksionale, t\u00eb cilat nuk do t\u00eb lidheshin p\u00ebr ndonj\u00eb territor t\u00eb caktuar, por do ta p\u00ebrb\u00ebnin pjes\u00ebtar\u00ebt e pakic\u00ebs komb\u00ebtare t\u00eb caktuar nga territori i gjith\u00ebmbarsh\u00ebm i shtetit konkret. Si argument kryesor p\u00ebr k\u00ebt\u00eb form\u00eb t\u00eb autonomis\u00eb theksohet disperziteti i vendbanimit t\u00eb tyre.<\/p>\n<p>Form\u00eb e participimit politik t\u00eb pakicave komb\u00ebtare i cili \u00ebsht\u00eb tejet i pranish\u00ebm n\u00eb praktik\u00eb dhe i cili jep rezultate t\u00eb mira, jan\u00eb t\u00eb ashtuquajturat forume konsultative pran\u00eb organeve t\u00eb shkall\u00ebve t\u00eb ndryshme t\u00eb pushtetit legjislativ, ekzekutiv dhe administrativ. Ato n\u00eb m\u00ebnyra t\u00eb ndryshme mund t\u00eb p\u00ebrfshihen n\u00eb procesin e marrjes s\u00eb vendimeve, kurse q\u00ebndrimet e tyre mund t\u00eb ken\u00eb shkall\u00eb t\u00eb ndryshme t\u00eb detyrueshrm\u00ebris\u00eb p\u00ebr organin i cili merr vendime. Zgjidhjet m\u00eb t\u00eb shpeshta jan\u00eb se lidhur me \u00e7\u00ebshtjet e tilla nuk mund t\u00eb merret vendim pa dh\u00ebnien e mund\u00ebsis\u00eb paraprake forumeve konsulatative q\u00eb t\u00eb deklarohen n\u00eb lidhje me to, q\u00eb q\u00ebndrimi i k\u00ebtyre forumeve duhet t\u00eb\u00a0 merret parasysh me rastin e marrjes s\u00eb vendimit dhe q\u00eb organi i cili merr vendimin \u00ebsht\u00eb i detyruar p\u00ebr ta informuara forumin konsultativ n\u00eb lidhje me q\u00ebndrimin q\u00eb ka marr\u00eb sipas propozimit, respektivisht k\u00ebrkes\u00ebs s\u00eb tij.<\/p>\n<p>Aksioni afirmativ nuk \u00ebsht\u00eb n\u00eb kolizion me konceptin e shtetit qytetar. P\u00ebrkundrazi, ato jan\u00eb mjaft kompatibile. P\u00ebr shembull, nj\u00eb shtet liberalist, si SHBA-ja, e cila p\u00ebr nj\u00eb koh\u00eb t\u00eb gjat\u00eb do t\u00eb na jap\u00eb shembull dhe do t\u00eb jet\u00eb model p\u00ebrkitazi me zhvillimin e demokracis\u00eb, t\u00eb shoq\u00ebris\u00eb qytetare dhe t\u00eb shtetit qytetar si dhe p\u00ebrkitazi me respektimin e parimit t\u00eb profesionalizmit u qyshse n\u00eb vitin 1964 kan\u00eb sh\u00ebnuar n\u00eb Amendamentin VII t\u00eb Ligjit mbi t\u00eb drejtat e qytetar\u00ebve: \u201cAi pun\u00ebdh\u00ebn\u00ebs i cili n\u00eb \u00e7far\u00ebdo m\u00ebnyre ka diskriminuar t\u00eb pun\u00ebsuarit, duhet t\u00eb zbatoj\u00eb parimin e diskriminimit pozitiv n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb korrigjoj\u00eb praktik\u00ebn e gabuar t\u00eb m\u00ebparshme\u201d.<\/p>\n<p>Presidenti Lindon Xhonson m\u00eb 1965 nxori Dekretligjin me t\u00eb cilin i urdh\u00ebroi t\u00eb gjitha organet federale q\u00eb me rastin e plot\u00ebsimit t\u00eb vendeve t\u00eb pun\u00ebs, me rastin e avancimit n\u00eb detyr\u00eb, t\u00eb zbatohet parimi i diskriminimit pozitiv, madje edhe n\u00eb qoft\u00eb se nuk ka pasur kurr\u00eb raste t\u00eb diskriminimit negativ. Nga fillimi i viteve t\u00eb 70-ta t\u00eb shekuilit t\u00eb kaluar Komiteti p\u00ebr Mund\u00ebsi t\u00eb Barabarta t\u00eb Pun\u00ebsimit shkoi edhe nj\u00eb hap m\u00eb tej, duke p\u00ebrcaktuar n\u00eb baz\u00eb t\u00eb treguesve statistikor\u00eb kuotat e llogaritura t\u00eb pun\u00ebsimit t\u00eb grupeve t\u00eb caktuara etnike dhe minoritare.<\/p>\n<p>N\u00eb Kushtetut\u00ebn e Malit t\u00eb Zi, n\u00eb nenin 79, nd\u00ebr t\u00eb tjera, p\u00ebrcaktohet q\u00eb: Pjes\u00ebtar\u00ebve t\u00eb popujve pakic\u00eb dhe t\u00eb bashk\u00ebsive t\u00eb tjera nacionale t\u00eb pakicave u garantohet e drejta e p\u00ebrfaq\u00ebsimit p\u00ebrpjesetimor n\u00eb sh\u00ebrbimet publike, n\u00eb organet e pushtetit qendror dhe t\u00eb vet\u00ebqeverisjes lokale. Mir\u00ebpo, kjo dispozit\u00eb e Kushtetut\u00ebs zbatohet n\u00eb m\u00ebnyr\u00eb jokonsekuente n\u00eb praktik\u00ebn shoq\u00ebrore konkrete, n\u00eb radh\u00eb t\u00eb par\u00eb kur \u00ebsht\u00eb fjala p\u00ebr pjes\u00ebtar\u00ebt e komb\u00ebsis\u00eb shqiptare. Me fjal\u00eb t\u00eb tjera, n\u00eb vazhdim\u00ebsi \u00ebsht\u00eb i pranish\u00ebm problemi i n\u00ebnp\u00ebrfaq\u00ebsimit t\u00eb pjes\u00ebtar\u00ebve t\u00eb pakic\u00ebs komb\u00ebtare shqiptare n\u00eb institucionet e sistemit, si\u00e7 jan\u00eb: gjyq\u00ebsia, prokuroria, ministrit\u00eb e ve\u00e7anta, organet e ve\u00e7anta t\u00eb vet\u00ebqeverisjes lokale, sh\u00ebrbimet publike dhe institucionet e tjera shtet\u00ebrore me r\u00ebnd\u00ebsi jetike p\u00ebr realizimin e t\u00eb drejtave t\u00eb njeriut dhe t\u00eb pakicave, q\u00eb \u00ebsht\u00eb juridikisht dhe politikisht e pabazuar dhe e papranueshme.<\/p>\n<p>Dhe n\u00eb fund, mund t\u00eb konstatohet, se t\u00eb gjith\u00eb duhet ta ken\u00eb t\u00eb qart\u00eb se m\u00ebnyra e trajtimit t\u00eb pakicave p\u00ebrb\u00ebn sfid\u00eb nga e cila shumica jep provimin nga sfera e demokracis\u00eb, t\u00eb drejtave t\u00eb njeriut dhe pushtetit t\u00eb s\u00eb drejt\u00ebs.
